Waiver of Liability & Assumption of Risk Agreement
I AGREE TO THE FOLLOWING TERMS AND CONDITIONS FOR PARTICIPATION IN ANY IN-PERSON OR ONLINE PROGRAMS, SERVICES, OR ACTIVITIES PROVIDED BY Forme Pilates (“Studio”).
1. Acknowledgment of Activities & Voluntary Participation
I voluntarily choose to participate in services and activities offered by the Studio, including but not limited to Pilates classes, private training, workshops, wellness services, virtual programming, founders events, special events, and events (collectively, the “Activities”). I understand that my participation is entirely voluntary.
2. Express Assumption of Risk
I understand that the Activities involve inherent and significant risks, including but not limited to: falls, equipment malfunction, improper use of equipment, physical exertion, muscle strain, joint injury, sprains, fractures, cardiovascular complications, illness, permanent disability, and death.
I expressly and voluntarily assume all risks, whether known or unknown, inherent or not inherent, and whether arising from ordinary negligence or otherwise, to the fullest extent permitted under California law.
3. Health Representation & Responsibility
I represent and warrant that:

I am physically and mentally capable of safely participating in the Activities;

I have no medical condition that would impair my ability to participate or increase risk;
-
I have consulted, or have had the opportunity to consult, a physician prior to participation.
I agree that I am solely responsible for monitoring my physical condition and will immediately stop participation if I experience pain, discomfort, or any abnormal symptoms. I further agree to disclose any relevant medical conditions, injuries, or limitations to the Studio prior to participation and as they arise.
The Studio reserves the absolute right to deny or terminate my participation at any time for safety reasons.
4. Release of Liability (Including Negligence)
To the fullest extent permitted by California law, I knowingly, voluntarily, and irrevocably release, waive, and discharge Forme Pilates Studio and its owners, officers, directors, employees, instructors, contractors, agents, affiliates, and landlord (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, or expenses of any kind (“Claims”), including those arising from the active or passive negligence of any Released Party.
This release applies to any and all Claims arising out of or related to:

Participation in the Activities;

Use of Studio facilities, equipment, or services;
-
Presence on the Studio premises or participation in virtual programming.
5. Indemnification & Hold Harmless
I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all Claims, including attorneys’ fees and costs, arising out of or related to:

My participation in the Activities;
-
My negligence or misconduct;
-
Any Claims brought by or on behalf of a minor I enroll or any third party related to my participation.
6. Covenant Not to Sue
I agree that neither I, nor anyone acting on my behalf (including heirs, assigns, or representatives), will bring or maintain any lawsuit against any Released Party for any Claim released in this Agreement.
7. Photo & Media Release
I grant the Studio permission to photograph or record me during Activities and to use my image, likeness, or voice for marketing, advertising, and promotional purposes in any media, worldwide and in perpetuity, without compensation, unless I provide written notice opting out.
8. Communicable Illness (Including COVID-19)
I acknowledge that participation in the Activities may expose me to communicable illnesses, including COVID-19. I understand that such exposure may result in illness, injury, permanent disability, or death.
I voluntarily assume all risks related to such exposure and release the Released Parties from any Claims arising from or related to the transmission of any communicable disease, including those arising from the negligence of any Released Party, to the fullest extent permitted by law.
9. California Civil Code §1542 Waiver
I expressly waive the protections of California Civil Code §1542, which states:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in their favor at the time of executing the release…”
I understand and agree that this waiver is intended to release all Claims, including unknown or unsuspected Claims.
10. Studio Policies (Binding Terms)

All sales are final.

Classes require a minimum of 12 hours’ notice for cancellation.

Private and duet sessions require 24 hours’ notice.

Late cancellations or no-shows will result in a $25 fee for unlimited memberships and forfeiture of credits for class packs or session-based memberships.
I agree that these policies are binding and enforceable.
11. Minors
If I am enrolling a minor, I certify that I am the parent or legal guardian and agree to all terms of this Agreement on the minor’s behalf.
I accept full responsibility for all risks, injuries, and Claims arising from the minor’s participation and agree to indemnify the Released Parties accordingly. A signed in-person waiver may be required.
12. Severability & Governing Law
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be governed by and interpreted under the laws of the State of California.
Acknowledgment & Agreement
I acknowledge that I have carefully read this Waiver of Liability & Assumption of Risk Agreement, fully understand its terms, and understand that I am giving up substantial legal rights, including the right to sue.
I voluntarily agree to this Agreement freely and without inducement.
